MAXIMUM
QUANTITIES OF VETERINARY MEDICINE RESIDUES IN FOOD INTENDED FOR HUMAN
CONSUMPTION
Having
had before me;
What
is provided under articles 4 and 6 of decree-Law No. 2.763, of 1979, and
articles 1, 97, and 280 of Supreme Decree No. 977, of August 6, 1996, issued by
the Ministry of Health, which approves the
Sanitary Regulations for Food, and
Whereas
-It
is necessary to set maximum limits to residues (EMR) of veterinary drugs in
food intended for human consumption, in order to protect the health of the
population;
-The
adoption of maximum limits to residues of veterinary drugs in food was based on
the recommendations of the FAO/WHO Joint Program on Food Standards, Codex
Alimentarius Commission on residues of veterinary drugs in food, or the
concentrations established by the U. S. Food and Drug Administration, or by the
European Union;
-Bearing
in mind, in addition, that the provisions of the Codex Alimentarius have been
recognized as reference for the international exchange of food by the Agreement
on Health and Plant Health Measures of the World Trade Organization, whereof
this country is a member, I hereby issue the following
Resolution

The following maximum limits are hereby set for residues of veterinary drugs in
food intended for human consumption, as provided under item 6 below.

veterinary drug is a substance applied or given to any animal destined to
produce food, such as animals that produce milk or meat, poultry, fish, or
bees, for therapeutic, prophylactic, or diagnostic purposes, or to change
physiological functions or behavior.

The maximum limit for residues (MLR) of veterinary drugs is the maximum
concentration of residues resulting from use of a given veterinary drug
expressed in milligrams per kilo or micrograms per kilo based on fresh weight,
permissible in a food or on the surface thereof.

Breaches of the provisions hereunder shall be penalized by the Health Agencies
in whose jurisdictions such breaches were committed, after initiating the
required summary proceeding, pursuant to the provisions in Book X of the Health
Code.

The present resolution shall become effective sixty days after publication
thereof in the Official Gazette.
